TERMS AND CONDITIONS OF USE


-Introduction

Please make sure that you have read and understood the “Terms of Use“ and ”Privacy Policy“, hereinafter referred to as “Terms“, which consist of a “Agreement“ entered into between “MY LOJA STORE“ and “User“ after the manifestation of “Accept“. The Acceptance of Terms is indispensable for any use of the “MY LOJA STORE App“ available on the App Store and in future on Play Store, together called “Applications“. Registration as a User is prohibited for anyone who is legally incapacitated or who does not fully agree with all of the Terms. The Terms legally bind the User with respect to the current or new services offered by My Loja Store. By registering as a User and / or using the applications or Services in any way, the User, regardless of whether or not to use the service, agrees to bind and comply with the Terms. The My Loja Store reserves the right to make changes/updates to the Terms at any time without prior notice and the simple use of the applications after changing/updating the Terms shall be in accordance therewith. If you do not agree to the changes, you must cancel your account and cease any and all use of the applications. In the absence of manifestation it will be understood that the User tacitly accepted the Terms and the Agreement will continue to bind the parties. We recommend that you review the Terms frequently to be aware of any updates.

-Register

Users who wish to use the application must complete the registration fields and provide valid and correct information. My Loja Store has criteria for using the application, and protects for itself the criterion of blocking the use. Registration information is the sole responsibility of the person who entered it. In the event of damage or loss of any kind, legal sanctions may be taken by My Loja Store in order to safeguard your interests and the integrity of other users of the system.

-Object and Responsibilities

The My Loja Store system (including the application and other platforms such as “Facebook“ and third party websites) consists of a sales, contact and product catalog control platform. The platform allows duly registered users to control products, customers and sales through a local database with the possibility of backup on a server and with data synchronization by multiple devices. The platform will eventually implement new features based on feedback from Users. The My Loja Store is partially free, with the restrictions of not allowing backup on a server, access to multiple users and with a limit of 35 products and 10 sales per month. The user has the option to subscribe to the 'My Loja Store Plus' plan so that the limits are 5000 active products, 15000 individual sales per month and have access to the automatic backup option.

To use the multi-user functionality, it is mandatory that each user has an active subscription to their Itunes account or Google Play . We remind you that your subscription payment cannot be transferred to another account, whether between accounts of the same service or different services. The services mentioned are iTunes and Google play. This functionality also requires an internet connection to register, change or delete data. For information inquiries, no connection is required, but with the offline application there is no guarantee that the data is up to date.

The My Loja Store has the backup functionality through login, in case the login is not created, the data is saved on the user's own device. When the user does not create the login for automatic backup, we have no way to recover the data in case of loss of the device or technical problem on the device. The user will only be able to log in to a new device with a minimum interval of 72 hours between the new access and the previous one. So after the user logs in on one device, he can only log in with the same user on another device at least 72 hours apart.

My Loja Store is not responsible for the data and purpose of using the Users application through the use of the application; by the availability of the synchronization system; for errors or inconsistencies in the provision of information that is produced; possible system errors and failures that result in loss of information.

-Intellectual Property

The trademarks, names, logos, domain names and other distinctive signs, as well as any and all content, design, art or layout published in the applications, are the exclusive property of My Loja Store. Any acts or contributions relating to decompilation, reverse engineering, modification of features, enhancement, alteration, merge or incorporation into any other programs or systems are prohibited. Any and all forms of reproduction, in whole or in part, permanent, temporary or provisional, free of charge or onerous, in any form, form or title of the applications are expressly prohibited.

-Penalties

Your use of the My Loja Store applications improperly in disagreement with these Terms will entail the exclusion of the User's registration and the prohibition of the use of the services. Your data will be preserved for use by the competent authorities. The User agrees to indemnify My Loja Store, its subsidiaries, subsidiaries, directors, officers, employees, representatives and employees for any loss, liability, claim or demand, for any damages due to or arising out of their use of the applications.

-Privacy Policy

The My Loja Store has the backup functionality through login, in case the login is not created, the data is saved on the user's own device. My Loja Store does not use your data for any marketing action and does not pass it on to third parties, having access only to the user who created the account. No data is collected from your device, the saved data is only that reported by the user himself, this data is saved on a server in case of loss of the device or technical defect.

My Loja Store is not responsible for the misuse or loss of personal data to which it does not have access or control. We are also exempt from liability for illegal and unauthorized use of this information as a result of misuse or diversion of your access credentials, negligent or malicious conduct as a result of acts or omissions on your part or someone authorized on your behalf.

MY LOJA STORE PLUS

My Loja Store is partially free, with the restrictions of not allowing server backup, access to multiple users and with a limit of 35 products and 10 sales per month. The user has the option to subscribe to the 'My Loja Store Plus' plan so that the limits are 5000 active products, 15000 individual sales per month and have access to the automatic backup option.

The plus version allows simultaneous access for up to 20 users, but each user must have a subscription for the devices to have simultaneous access to the same store.

The My Loja Store service offers extra functionality available through monthly subscription. My Loja Store reserves the right to open or close any of the features. It is not possible to transfer payments between accounts, if you use the application in a different Itunes / Google Play account you will have to make a new subscription. For the iOS app, the purchase of the service will be performed exclusively by in-app purchase. Payment will be charged to your iTunes Account as soon as you confirm your purchase. The iTunes Account will be charged again when your subscription renews automatically at the end of your current subscription period unless automatic renewal is disabled 24 hours before the end of the active subscription period and you can manage or turn off automatic renewal at settings of your Apple ID account at any time after purchase. For other platforms, the charge can be made via Play Store or by alternative means. For the Android app, payment will be taken directly from your Google Play account upon confirmation of purchase. Subscription automatically renews unless you turn off auto-renew at least 24 hours before billing date. The subscription can be managed by you on the device itself under Google Play Subscriptions.
